CLOSED SESSION  
Please take notice that the Commission intends to convene into closed session  
pursuant to Wis. Stat. 19.85(1)(c) for deliberating or negotiating the purchasing of  
public properties, the investing of public funds, and conducting other specified public  
business because competitive and bargaining reasons require a closed session  
(relating to possible land acquisition(s)) that may that may materially affect the  
Commission's I/I study scope, as well as that may materially affect the Commission's  
facility planning decisions; also pursuant to Wis. Stat. 19.85(1)(g) to confer with legal  
counsel for the Commission who is rendering oral or written advice concerning strategy  
to be adopted by the body with respect to litigation in which it is or is likely to become  
involved (relating pending disputes and claims arising out of the administration,  
interpretation, and enforcement of the Racine Area Intergovernmental Sanitary Sewer  
Service, Revenue-Sharing, Cooperation and Settlement Agreement dated April 25,  
2002). The Commission reserves the right to reconvene into open session following the  
closed session to take action on any of the above topics.

that the Wastewater Commission meet regarding legal issues, as well as  
bargaining and development opportunities, which, for competitive and  
bargaining reasons, require a Closed Session.

A motion was made by Mason , seconded by Jorgensen, to approve the  
amendments to the professional service agreement with Strand Associates in  
the amount of $60,000; to extend taking no actions on the curative actions  
regarding the Material Change in Circumstance claim; and to pursue the legal  
strategy as discussed in Closed Session. The motion PASSED by a Voice Vote.
