Title

Multifamily Development at 1520 and 1536 Clark Street

 

Resolved, that the final plans related to a conditional use permit for a multifamily development at 1520 and 1536 Clark Street (P.C.-16) are approved, subject to the following conditions:

 

a. That the plans presented to the Plan Commission on May 25, 2016 be approved, subject to the conditions contained herein.

 

b. That approval of the final plans for the properties at 1520 and 1536 Clark Street are consistent with the authorities granted through documents ZOrd.007-14 being an ordinance to rezone subject properties, Res.15-0022 being a use supplement for the subject properties, and Res.15-0023 being a conditional use permit for a multifamily residential development for the subject properties.

 

c. That all uses at 1520 and 1536 Clark Street be permitted and/or prohibited as is consistent with ZOrd.007-14, Res.15-0022, and Res.15-0023.

 

d. That the aesthetics of the design of this project shall comply with the approved by the Downtown Area Design Review Commission on May 18, 2016 per 114-639, except as may be amended herein.

 

e. That all applicable codes and ordinances shall be complied with unless excepted herewith, and all required permits acquired.

 

f. That this approval facilitates the following exceptions to the zoning ordinance:

1. The reduction in required off-street parking spaces [114-1188(1)] from 111 spaces to 101 spaces.

2. The waiving of the transition yard requirement [114-590] to adjacent industrial uses.

 

g. That signage is not approved with this review.  All proposed signage shall be reviewed and approved by the Director of City Development prior to issuance of a sign permit.

 

h. That all dumpster and trash enclosure shall be screened from view in a manner to be approved by the Director of City Development.

 

i. That prior to the issuance of an occupancy permit, a driver-pedestrian warning system shall be installed and operational at the overhead garage door along 16th Street.  Said system’s plan shall be submitted to the Director of City Development and made part of the development file.

 

j. That no exit/entrance doors shall swing into public sidewalks or street areas unless suitable safety precautions are in place and sidewalk obstruction privileges have been granted by the Common Council.

 

k. That the owner is responsible for all site maintenance, including but not limited to removal of weeds, building and landscaping upkeep, and snow and trash removal.

 

l. That financial sureties, the issuance of permits, and the approval of improvements and occupancies shall be governed by the terms and conditions as expressed herein and in a development agreement to be executed between the City of Racine, the developer, the owner and all other applicable parties.

 

m. That by operating under this Conditional Use, the owner gives permission to the City to enter upon the property for verification of compliance to the conditions expressed herein

 

n. That no minor changes be made to the conditions of this permit without the approval of the Plan Commission, and no major changes be made without the approval of the Common Council.

 

o. That this conditional use permit is subject to review by the Plan Commission for compliance with the listed conditions.
