The Common Council of the City of Racine do ordain as follows: Part 1: Article V, Section 5-8 of the Charter Ordinances of the City of Racine is hereby amended by amending the section to read as follows: “Section 5-8. Hours and conditions of operation. To amend Chapter 5 of the Municipal Code of the City of Racine, Wisconsin relating to Hours of Operation of Convenience Stores and Gas Station/Auto Repair Facilities.
 
The Common Council of the City of Racine do ordain as follows:
 
Part 1:
 
To amend Article V of the Charter Ordinances of the City of Racine, Wisconsin relating to Hours and Conditions of Operation of Gasoline Service Stations.
 
The Common Council of the City of Racine do ordain as follows:
 
Part 1:
 
Article V, Section 5-8 of the Charter Ordinances of the City of Racine is hereby amended by amending the section to read as follows:
 
"Section 5-8.  Hours and conditions of operation.
 
(1)  If any homicide, murder, battery, sexual assault, false imprisonment, kidnapping, reckless endangerment of safety, robbery, or disorderly conduct as identified and defined by Wisconsin Statutes, weapons crime in violation of secs. 941.20 through 941.299 of the Wisconsin Statutes, or act of prostitution in violation of secs. 944.30 through 944.34 of the Wisconsin Statutes occurs, after the effective date of this ordinance, upon the premises of any gasoline service station as defined by and licensed pursuant to Article V of the Charter Ordinances of the City of Racine and/or secs. 22-476 and 22-477 of the Municipal Code of the City of Racine, such gasoline service station shall be subject any or all of the provisions of subsection (2) by order of the Common Council.
 
(2) Such holder of a license for a gasoline service station, whether operated in connection with retailing of edible or non-edible commodities, or both, shall
 
(a)  not sell or deliver any goods, wares, merchandise, or personal property of any kind and nature to the ultimate consumer nor take an order therein for delivery therein of any goods, wares, merchandise, and personal property of every kind and nature including any edible or non-edible commodities, including any sale or delivery for off-premises consumption, between the hours of midnight of any day of the week and 4:00 a.m. of that same day, anywhere in the City of Racine.  If any provision of Chapter 22 or the Zoning Code, is more stringent as to hours of operation of businesses that are subject to this section, then Chapter 22 or the Zoning Code provision shall be given effect.  Gas stations may keep one or more pumps open that can be operated by credit card when such stations are closed;
 
(b)  employ such additional staff as is necessary for the safe operation of such gasoline service station;
 
(c)  employ such unarmed or armed private security person as defined by Chapter 22, Article XXVII of the Municipal Code of the City of Racine, as may be deemed useful and necessary to ensure the safe operation of such gasoline service station;
 
(d)  install and operate such additional security measures as may be deemed useful and necessary to ensure the safe operation of such gasoline service station;
 
(e)  have such premise's conditional use permit(s) revoked or modified;
 
(f)  be subject to such additional and further sanctions as may be imposed by the Common Council."
 
Part 2:
 
This ordinance shall become effective 60 days after its date of passage by the City Council and approval by the Mayor.
