Subject: (Direct Referral) Communication from Steve Stanbrook, 3063 Michigan Boulevard, requesting an amendment to the easement on the north side of their property. (Res.10-2019)
Recommendation of the Public Works and Services Committee on 5-11-10: That the easement agreement approved by Resolution 09-1746, of December 15, 2009, be amended to allow a brick fence with iron gates to encroach upon the easement with the stipulation that the City may, without warning, remove said brick fence and iron gates, at no cost to the City, to effect necessary repairs or reconstruction to the storm sewer.
Furthermore, any damage caused to said brick fence and iron gates, for any reason, by the storm sewer condition or the City activities to maintain, improve, replace or enlarge such storm sewer, shall be done at no cost to the City of Racine and that the property owner shall bear all risk associated with the placement of this brick fence and iron gates within the existing easement.
Further recommends that the property owner be charged a $50.00 fee to cover administrative costs associated with filing this item with the Register of Deeds office.
Fiscal Note: The property owner shall bear responsibility for maintenance of this brick fence and iron gates at no expense to the City.
