Title: Subject: Communication from the developer of Woodland Pointe, Lincoln Lutheran requesting that the proposed sanitary sewer and water main that will serve the 14-unit condo development be public utilities, owned and maintained by the City. Recommendation: That the Mayor and City Clerk be authorized and directed to enter into a development agreement with the developer of the Woodland Pointe Condominium project. Terms of the development agreement will include: A. The construction of storm and sanitary sewers to City specifications which will be considered services and which will be the responsibility of the private property owners to maintain in the future. B. The construction of water mains in accordance with the requirements of the Racine Water Utility within easements satisfactory to perform future maintenance activities. Recommendation: That the Mayor and City Clerk be authorized and directed to enter into a development agreement with the developer of the Woodland Pointe Condominium project. Terms of the development agreement will include:

 

A. The construction of storm and sanitary sewers to City specifications which will be considered services and which will be the responsibility of the private property owners to maintain in the future.

 

B. The construction of water mains in accordance with the requirements of the Racine Water Utility within easements satisfactory to perform future maintenance activities. These water mains will be owned by the Racine Water Utility.

 

C. The paving of Kasper Street from the south project limits to Carlton Drive with portland cement concrete pavement. The cost to be paid fully by the developer.

 

Fiscal Note: The assessment to the existing property owners along Kasper Street will be waived due to this agreement.
