Request to convene in closed session to discuss, with the Executive Committee, strategy with respect to litigation in which the City of Racine is or is likely to become involved, specifically Bielefeldt v. Dickert v. Racine, and more specifically addressing Mayor Dickert's right to indemnification pursuant to sec. 895.46, Wis. Stats.
Resolved, that authorization for the Racine City Attorney's Office to provide legal defense for John Dickert, as Mayor of the City of Racine, in Racine County Circuit Court Case 11-CV-1078 be approved;
Further resolved, that authorization for the the Racine City Attorney's Office to respond to the Third-Party Complaint in such case by admitting that John Dickert was carrying out the duties as the Mayor of the City of Racine and acting within the scope of his employment for the City of Racine be approved;
Further resolved, that Mayor Dickert sign a waiver indemnifying the City of Racine and guaranteeing to reimburse the City of Racine if it is found by the courts that he was not acting in an official capacity or within the scope of his employment.
Further resolved, that authorization for the Racine City Attorney's Office to respond to the Third-Party Complaint in such case by admitting that John Dickert, and Mayor of the City of Racine, is entitled to full indemnification, including the full cost of his defense, from the City of Racine be approved.
