Title: Subject: Ordinance No. 2-08 of March 4, 2008, to amend Secs. 66-191, 66-192, 66-193 and 66-194 and to repeal and recreate Sec. 66-195 of the Municipal Code of the City of Racine, Wisconsin relating to Offenses - Vandalism; Graffiti. (Ord.02-08) Recommendation: That Ordinance No. 2-08, of March 4, 2008, to amend Secs. 66-191, 66-192, 66-193 and 66-194 and to repeal and recreate Sec. 66-195 of the Municipal Code of the City of Racine, Wisconsin relating to Offenses - Vandalism, Graffiti, be amended as follows: That Sec. 66-195(b) be amended to read: "Upon written request received by the department that issued the notice and order, prior to expiration of the time provided for compliance, the chief building inspector may, for just cause, grant an extension of time for compliance. Each day of violation shall constitute a separate offense." That Sec. 66-195(c) shall be amended to read: "If the owner fails to comply with the order(s) after being provided with a written notice and order ...

Recommendation:  That Ordinance No. 2-08, of March 4, 2008, to amend Secs. 66-191, 66-192, 66-193 and 66-194 and to repeal and recreate Sec. 66-195 of the Municipal Code of the City of Racine, Wisconsin  relating to Offenses - Vandalism, Graffiti, be amended as follows:
 
That Sec. 66-195(b) be amended to read: "Upon written request received by the department that issued the notice and order, prior to expiration of the time provided for compliance, the chief building inspector may, for just cause, grant an extension of time for compliance. Each day of violation shall constitute a separate offense."
 
That Sec. 66-195(c) shall be amended to read: "If the owner fails to comply with the order(s) after being provided with a written notice and order for removal and upon the expiration of any extension(s) granted, the chief building inspector may remove or cover the graffiti and all costs, fees and expenses incurred in the removal shall be levied against the property as a special charge. Such costs shall be in addition to any other enforcement actions taken under this code."
 
Further recommends that Ordinance No. 2-08, of March 4, 2008, as amended, be adopted.
