Ordinance No. 12-07
To amend Chapter 5 of the Municipal Code of the City of Racine, Wisconsin relating to Hours of Operation of Convenience Stores and Gas Station/Auto Repair Facilities.
The Common Council of the City of Racine do ordain as follows:
Part 1:
To amend Article V of the Charter Ordinances of the City of Racine, Wisconsin relating to Hours and Conditions of Operation of Gasoline Service Stations.
The Common Council of the City of Racine do ordain as follows:
Part 1:
Article V, Section 5-8 of the Charter Ordinances of the City of Racine is hereby amended by amending the section to read as follows:
“Section 5-8. Hours and conditions of operation.
(1) If any homicide, murder, battery, sexual assault, false imprisonment, kidnapping, reckless endangerment of safety, robbery, or disorderly conduct as identified and defined by Wisconsin Statutes, weapons crime in violation of secs. 941.20 through 941.299 of the Wisconsin Statutes, or act of prostitution in violation of secs. 944.30 through 944.34 of the Wisconsin Statutes occurs, after the effective date of this ordinance, upon the premises of any gasoline service station as defined by and licensed pursuant to Article V of the Charter Ordinances of the City of Racine and/or secs. 22-476 and 22-477 of the Municipal Code of the City of Racine, such gasoline service station shall be subject any or all of the provisions of subsection (2) by order of the Common Council.
(2) Such holder of a license for a gasoline service station, whether operated in connection with retailing of edible or non-edible commodities, or both, shall
(a) not sell or deliver any goods, wares, merchandise, or personal property of any kind and nature to the ultimate consumer nor take an order therein for delivery therein of any goods, wares, merchandise, and personal property of every kind and nature including any edible or non-edible commodities, including any sale or delivery for...
