Title
Tire Service Facility at 2001 Racine Street
Resolved, that the request by Romayne Wilson, represented by Attorney Ken Rusch, for a conditional use permit to operate a new and used tire business at 2001 Racine Street is approved, subject to the following conditions:
a. That the plans presented to the Plan Commission on May 11, 2016 be approved, subject to the conditions contained herein.
b. That approval of this conditional use is contingent upon the approval of the rezoning of the property from B-1 Neighborhood Convenience to B-1 with a FD FLEX Development Overlay (ZOrd. 003-16 & Use Supplement 0412-16).
c. That all applicable codes and ordinances shall be complied with and required permits acquired.
d. That vehicle repair or service, beyond tire repair or replacement for private passenger vehicles, is prohibited.
e. That a Waste Tire Generator license shall be obtained from the City Clerk’s office prior to issuance of an occupancy permit. Tires awaiting disposal or being delivered must be stored indoors at all times.
f. That the towing of vehicles to and from the site is prohibited, and no tow truck may be kept on-site.
g. That the sale and storage of automobiles is prohibited.
h. That all business operations shall take place inside the building, during stated hours of operation, with the doors closed.
i. That it is the responsibility of the owner/operator to ensure noise emissions remain at acceptable levels, and to further mitigate noise emissions if deemed necessary by the City.
j. That no outside storage or display is allowed at any time.
k. That a site-specific photometric plan be provided to the Department of City Development for review and approval prior to lighting installation and issuance of an occupancy permit.
l. That signage is not approved with this review. All proposed signage shall be reviewed and approved by the Department of City Development prior to issuance of a sign permit.
