The Common Council of the City of Racine do ordain as follows: Part 1: Section 18-369(c) of the Municipal Code of the City of Racine, Wisconsin is hereby amended by adding the following after “(c) (2)”: “(3) It shall be unlawful to burn more than three times a week in a permanent or portable outdoor fireplace unless a permit is obtained from the Fire Chief or his/her designee. (4) It shall be unlawful to burn within ten (10) feet of a property line or structure. To amend Sec. 18-369(c) and create 18-369(e), (f) and (g) of the Municipal Code of the City of Racine, Wisconsin relating to Building Code - Chimneys and Fireplaces; Outdoor fireplaces and outdoor cooking facilities.

The Common Council of the City of Racine do ordain as follows:

Part 1:

Section 18-369(c) of the Municipal Code of the City of Racine, Wisconsin is hereby amended by adding the following after “(c) (2)”:

“(3) It shall be unlawful to burn more than three times a week in a permanent or portable outdoor fireplace unless a permit is obtained from the Fire Chief or his/her designee.

(4) It shall be unlawful to burn within ten (10) feet of a property line or structure.

(5) Burning shall be permitted between the hours of noon and 11:00 p.m. and shall be completely extinguished upon completion of the activity or by 11:00 p.m., whichever occurs first.”

Part 2:

Section 18-369 of the Municipal Code of the City of Racine, Wisconsin is hereby amended by creating the following at the end of the section:

“(e) If any part of this ordinance is found to be in conflict with any other statute, ordinance or any other part of this ordinance, the most restrictive or highest standard shall prevail. If any part of this ordinance is explicitly prohibited by federal or state statute that part shall not be enforced.

(f) Any person who initiates and/or conducts any kind or type of outdoor fire shall be fully responsible for all fire suppression costs incurred to control, suppress, and/or extinguish the fire.

(g) Any law enforcement officer of the City of Racine or the Fire Chief (or authorized representative of the Fire Chief) shall have the right to enter onto any private property within the City of Racine upon which an outdoor fire is burning, for the purposes of inspecting the property, to ascertain whether the fire is in compliance with the provisions of this chapter; provided, this right to inspect shall not...
