Ordinance 01-15
To repeal and recreate Section 70-101. - Closing Hours of Chapter 70, Article III. Division 2 of the Municipal Code of the City of Racine, Wisconsin.
The Common Council of the City of Racine, Wisconsin do ordain as follows:
Part 1: Repeal and recreate subsection (a) of Section 70-101. - Closing Hours of the Municipal Code of the City of Racine, Wisconsin as follows:
“(a) Park Closing Hours.
City parks and parkways shall be closed to all persons each day from 10:00 p.m. until 6:00 a.m., with the following exceptions:
1. Vehicular traffic moving upon streets or roadways which run through a park;
2. Sports leagues scheduled by the City;
3. Recreational activities including fitness or fishing and other community events expressly approved by the Director of Parks, Recreation and Cultural Services.”
Part 2: Repeal and recreate subsection (b) of Section 70-101. - Closing Hours of the Municipal Code of the City of Racine, Wisconsin as follows:
“(b) The park closing prohibitions shall not apply to members of organizations and their families when such organizations have received approval of the common council to be on park grounds during closed hours in a designated area on specific dates. Such approval shall be conditioned upon the City receiving from the organization a cash bond in an amount established by the Parks, Recreations and Cultural Services Board. Such a bond shall be forfeited by the organization to the extent required to repair or replace park property or facilities damaged by negligence or vandalism during the time of the organization’s use of such park and facilities, notwithstanding the fact that such use may not be exclusive.”
Part 3: Repeal and recreate subsections (c), (d), (e), (f), (g), (h), (i), (j), (k), (l), (m), (n), (o), (p), (q), and (r) of Section 70-101. - Closing Hours of the Municipal Code of the City of Racine, Wisconsin.
