Ordinance 0014-18 - Discrimination and Affirmative Action/Human Rights Commission

 

An ordinance to amend Chapter 62, Article II of the Municipal Code of the City of Racine, Wisconsin.

 

The Common Council of the City of Racine, Wisconsin, do ordain as follows:

 

Part 1: Amend Chapter 62, Article II, Section 62-26 of the Municipal Code of the City of Racine, Wisconsin, as follows:

 

Insert the following definitions in appropriate alphabetical-order placement:

 

Bisexual means people who are emotionally, romantically, or sexually attracted to more than one sex, gender, or gender identity though not necessarily simultaneously, in the same way or to the same degree.

 

Gay means a person who is emotionally, romantically, or sexually attracted to members of the same gender. Gay is often used to describe homosexual males, but lesbians may also be referred to as gay.

 

Gender identity means the actual or perceived gender-related identity, expression, appearance, or mannerisms, or other gender-related characteristics of an individual, regardless of the individual’s designated sex at birth.

 

Lesbian means a woman who is emotionally, romantically, or sexually attracted to other women.

 

LGBTQ is an acronym for “lesbian, gay, bisexual, transgender, and queer or questioning.”

 

Queer means fluid gender identities and sexual orientations.

 

Questioning refers to people who are in the process of exploring their sexual orientation or gender identity.

 

Sexual orientation means an inherent or immutable enduring emotional, romantic, or sexual attraction to other people.

 

Transgender is an umbrella term for people whose gender identity or expression is different from cultural expectations based on the sex they were assigned at birth. Being transgender does not imply any specific sexual orientation. Therefore, transgender people may identify as straight, gay, lesbian, bisexual, or some other identity or orientation.

 

In the definition of “Discriminate, discrimination, and discriminating,” insert the words “gender identity,” before the words “sexual orientation.”

 

Part 2: Amend Chapter 62, Article II, and section 62-27(a) of the Municipal Code of the City of Racine, Wisconsin, as follows:

 

Insert the words “gender identity,” before the words “sexual orientation.”

 

Part 3: Amend Chapter 62, Article II, and section 62-29 of the Municipal Code of the City of Racine, Wisconsin, as follows:

 

Insert the words “one of whom self-identifies as a member of the LGBTQ community, one of whom has a disability as defined in section 62-26,” between the words “aldermen,” and the words “and one,” in subsection 62-29(a).

 

Part 4: Amend Chapter 62, Article II, and section 62-30 of the Municipal Code of the City of Racine, Wisconsin, as follows:

 

In both locations, insert the words “gender identity,” before the words “sexual orientation” in subsection 62-30(7).

 

Part 5: Amend Chapter 62, Article II, and section 62-38 of the Municipal Code of the City of Racine, Wisconsin, as follows:

 

Insert the words “gender identity,” before the words “sexual orientation” in both subsections 62-38(1) and (2).

 

Part 6: Amend Chapter 62, Article II, and section 62-43 of the Municipal Code of the City of Racine, Wisconsin, as follows:

 

Insert the words “gender identity,” before the words “sexual orientation” in subsections 62-43(1), (2), (3), (4), (5), (6), (7), and (15).

 

Part 7: This ordinance shall take effect upon passage by a majority vote of the members-elect of the City of Racine Common Council and publication or posting as required by law.
